It was an incomplete thought. Most states, including California, struggled to establish truly free public schools. Legal argument persisted, in particular in the American Midwest and South, regarding the appropriateness of public taxation to support public education. Such arguments remained salient for those who opposed the idea of taxes as an unfair redistribution of wealth. Roads and law enforcement were acceptable forms of local taxation, but schooling other people’s children in an era of agricultural labor and apprenticeship remained controversial.

Expanding access to education and improving its organization and quality became broadly acceptable political goals. Increased educational opportunities would encourage socioeconomic mobility, facilitate the Americanization of the immigrant, and cultivate the “natural” development of community and business leaders. Progressives gained political power and passed legislation to extend education to include the kindergarten. And in California, they laid plans to build the University of California into a powerful and central source of research and training.

In selecting students, a number of important stipulations were added, creating an initial set of principles that guided University of California admissions. Three of these principles were created in the original charter. The first principle was a natural extension of the rule on the selection of regents. It should be free of undue influence: The selection of students and granting of scholarships by the president should also be free of secular and political influence. Similar statements could be found in the charters of other state universities, and this principle would often be cited in battles over university admissions in the 1990s.
